{"id":192560,"date":"2021-06-29T11:20:13","date_gmt":"2021-06-29T09:20:13","guid":{"rendered":"https:\/\/scm.bz?p=192560"},"modified":"2021-06-29T11:20:13","modified_gmt":"2021-06-29T09:20:13","slug":"jl-algerian-authorities-alarming-crackdown-on-pro-democracy-en","status":"publish","type":"post","link":"https:\/\/scm.bz\/en\/jl-algerian-authorities-alarming-crackdown-on-pro-democracy-en\/","title":{"rendered":"Joint Letter: Algerian Authorities&#8217; Alarming Crackdown on Pro-Democracy Forces during HRC 47"},"content":{"rendered":"<p dir=\"ltr\">As the 47th\u00a0session of the Human Rights Council began in Geneva on June 21, 2021, Human Rights Watch, together with 81 domestic and international civil society groups, called on states to\u00a0address the worsening human rights situation in Algeria, which has involved cracking down on peaceful Algerian protesters, journalists, civil society groups, human rights defenders, trade unionists, lawyers, and even political parties. Countries participating in the 47th Human Rights Council session should condemn the effective criminalization of freedom of association, peaceful assembly and expression in Algeria.<\/p>\n<p dir=\"ltr\">We, the undersigned Algerian, regional and international non-governmental organizations, urge your government, individually and jointly with other states, to address the alarming crackdown on peaceful Algerian protesters, journalists, civil society members and organizations, human rights defenders and trade unionists during the 47th United Nations Human Rights Council (HRC) session.<\/p>\n<p dir=\"ltr\">Repression has increased drastically and a more assertive public position from states is\u00a0<a href=\"https:\/\/cihrs.org\/algeria-more-assertive-public-position-from-international-community-crucial-to-protecting-algerians-on-hirak-two-year-anniversary\/?lang=en\">crucial<\/a>\u00a0to protecting Algerians peacefully exercising their rights to freedom of expression, association and assembly.<\/p>\n<p dir=\"ltr\">We urge you, in relevant agenda items such as in the interactive dialogue with the High Commissioner under Item 2 or in the Interactive Debates with the Special Rapporteurs on freedom of expression and freedom of association and peaceful assembly under Item 3, to:<\/p>\n<ul dir=\"ltr\">\n<li>Condemn the escalating crackdown on peaceful protesters, journalists and human rights defenders, including the excessive use of force, the forced dispersal and intimidation of protesters and the continued arbitrary prosecutions, including on bogus terrorism-related charges;<\/li>\n<li>Urge authorities to cease all arbitrary arrests and prosecutions and release all individuals arbitrarily detained;<\/li>\n<li>Demand prompt, independent, impartial and effective investigations into allegations of torture and other ill-treatment, including allegations of physical, sexual and psychological abuse in detention and physical assault during protests &#8211; to ensure that suspected perpetrators are held accountable in fair, civilian trials;<\/li>\n<li>Urge authorities to amend or repeal overly broad provisions of the Penal Code<span class=\"tooltip-container\"><a id=\"_ftnref1\" title=\"\" href=\"https:\/\/www.hrw.org\/news\/2021\/06\/25\/joint-letter-algerian-authorities-alarming-crackdown-pro-democracy-forces-during#_ftn1\" name=\"_ftnref1\">[1]<\/a><\/span>\u00a0and other legislation used to repress fundamental rights and freedoms, notably law 12-06 on civil society organizations and law 91-19 on public meetings and demonstrations, in line with the International Covenant on Civil and Political Rights (ICCPR) and the African Charter on Human and Peoples&#8217; Rights (ACHPR).<\/li>\n<\/ul>\n<p dir=\"ltr\">Following the\u00a0<a href=\"https:\/\/www.reuters.com\/article\/algeria-protests-anniversary-kherrata-in-idUSKBN2AG1UK\">resumption<\/a>\u00a0of peaceful grassroots protests calling for democratic reform (the \u201cHirak\u201d) in February 2021<span class=\"tooltip-container\"><a id=\"_ftnref2\" title=\"\" href=\"https:\/\/www.hrw.org\/news\/2021\/06\/25\/joint-letter-algerian-authorities-alarming-crackdown-pro-democracy-forces-during#_ftn2\" name=\"_ftnref2\">[2]<\/a><\/span>, the government launched a renewed campaign of arrests and harassment through the criminal justice system. According to local activists monitoring the situation on the ground, as of 26 May, at least\u00a0<a href=\"https:\/\/www.facebook.com\/comitenationalpourlaliberationdesdetenusCNLD\/posts\/164035688299904\">183 individuals<\/a>\u00a0are detained for expressing their views online or for protesting peacefully. 86 of them were sentenced to prison terms between 16 and 24 May. Videos also\u00a0<a href=\"https:\/\/www.facebook.com\/2298875860335412\/videos\/292460275940715\">showed<\/a>\u00a0police beating protesters.<\/p>\n<p dir=\"ltr\">Despite the\u00a0<a href=\"https:\/\/www.aps.dz\/algerie\/117834-tebboune-grace-presidentielle-en-faveur-de-detenus-du-hirak\">announcement<\/a>\u00a0of a presidential pardon for thirty Hirak detainees on 18 February 2021, no presidential pardon decree has been issued to date.<\/p>\n<p dir=\"ltr\">In the past two months, Algerian and international organizations have condemned the\u00a0<a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2021\/05\/algeria-stop-using-unlawful-force-against-protesters\/\">unlawful use of force<\/a>\u00a0and intimidation against protesters, the\u00a0<a href=\"https:\/\/www.frontlinedefenders.org\/en\/statement-report\/harassment-algerian-human-rights-defenders-must-end\">harassment and ill-treatment<\/a>\u00a0of human rights defenders, the continued\u00a0<a href=\"https:\/\/cpj.org\/2021\/04\/algerian-journalist-rabah-kareche-detained-on-false-news-and-anti-state-allegations\/\">arbitrary detention<\/a>\u00a0and\u00a0<a href=\"https:\/\/twitter.com\/RSF_NordAfrique\/status\/1388195880583450625\">targeting<\/a>\u00a0of journalists, the\u00a0<a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2021\/04\/algeria-islamic-scholar-sentenced-to-three-year-prison-term-for-offending-islam\/\">criminalization of debate on religious matters<\/a>\u00a0and the lack of investigation into allegations of\u00a0<a href=\"https:\/\/www.facebook.com\/LADDH\/posts\/10157776935756759\">physical and sexual abuse<\/a>\u00a0in detention, including against a\u00a0<a href=\"https:\/\/www.algiersherald.com\/authorities-blame-the-victim-in-case-of-teenager-sexually-abused-in-custody-at-algiers-police-station\/\">minor<\/a>\u00a0separated from his parents.<\/p>\n<p dir=\"ltr\"><a href=\"https:\/\/www.frontlinedefenders.org\/en\/statement-report\/joint-statement-algeria-terrorism-charges-brought-against-human-rights-defenders\">Terrorism charges<\/a>\u00a0brought against fifteen human rights defenders, journalists and peaceful protesters on 29 April constitute a\u00a0<a href=\"https:\/\/www.amnestyalgerie.org\/2021\/05\/17\/algerie-il-faut-abandonner-les-fausses-accusations-contre-trois-defenseurs-des-droits-humains\/\">dangerous escalation<\/a>. If pursued by the court, it could establish a worrying precedent of targeting Algerians calling for reform.<\/p>\n<p dir=\"ltr\">Over the past year, there has been increasing recognition of the worsening human rights situation in Algeria, including by the Office of the High Commissioner for Human Rights (OHCHR)\u00a0<a href=\"https:\/\/www.ohchr.org\/EN\/NewsEvents\/Pages\/DisplayNews.aspx?NewsID=26851&amp;LangID=E\">in March<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.ohchr.org\/EN\/NewsEvents\/Pages\/DisplayNews.aspx?NewsID=27078&amp;LangID=E\">in May<\/a>\u00a02021, the\u00a0<a href=\"https:\/\/www.europarl.europa.eu\/doceo\/document\/TA-9-2020-0329_EN.html\">European Parliament<\/a>\u00a0and the\u00a0<a href=\"https:\/\/www.ourcommons.ca\/DocumentViewer\/en\/43-2\/house\/sitting-21\/hansard\">Canadian House of Commons<\/a>. During HRC 45, Belgium condemned judicial harassment against journalists and called on the authorities to guarantee freedom of expression. During the HRC 46, Iceland expressed concern about forced closures of Protestant churches and arbitrary application of COVID-19 restrictions.<\/p>\n<p dir=\"ltr\">The time is now for UN member states to address the increasing criminalization of freedom of association, peaceful assembly and expression in Algeria.
