{"id":191406,"date":"2020-10-05T17:42:17","date_gmt":"2020-10-05T15:42:17","guid":{"rendered":"https:\/\/scm.bz?p=191406"},"modified":"2020-10-05T18:08:02","modified_gmt":"2020-10-05T16:08:02","slug":"russias-role-in-human-rights-abuses-and-impunity-raise-questions-about-the-legitimacy-of-future-hrc-seat","status":"publish","type":"post","link":"https:\/\/scm.bz\/en\/russias-role-in-human-rights-abuses-and-impunity-raise-questions-about-the-legitimacy-of-future-hrc-seat\/","title":{"rendered":"Russia\u2019s Role in Human Rights Abuses and Impunity Raise Questions About the Legitimacy of Future HRC Seat"},"content":{"rendered":"<p dir=\"ltr\" style=\"direction: ltr; text-align: left;\"><b>Joint Letter<\/b><\/p>\n<p dir=\"ltr\" style=\"direction: ltr; text-align: left;\"><b>05 October 2020<\/b><\/p>\n<p dir=\"ltr\" style=\"direction: ltr; text-align: left;\"><span style=\"font-weight: 400;\">The United Nations General Assembly will elect new members for the Human Rights Council <\/span><span style=\"font-weight: 400;\">in October 2020.<\/span><span style=\"font-weight: 400;\"> Russia is running in a closed slate together with Ukraine for two seats, virtually granting Russia a seat at the Human Rights Council without scrutiny and challenge.\u00a0\u00a0<\/span><\/p>\n<p dir=\"ltr\" style=\"direction: ltr; text-align: left;\"><span style=\"font-weight: 400;\">The undersigned organizations call upon the UN Member States to not vote in favor of Russia as a message that human rights violations in a number of countries cannot go unpunished, and that Russia should not see its election and membership of the Human Rights Council as a reward to further impunity for the human rights violations committed in Syria, Ukraine, and Georgia.<\/span><\/p>\n<p dir=\"ltr\" style=\"direction: ltr; text-align: left;\"><span style=\"font-weight: 400;\">UN General Assembly Resolution 60\/251 asks that those voting for members of the Human Rights Council \u201ctake into account the contribution of candidates to the promotion and protection of human rights.\u201d This guidance applies to candidates\u2019 efforts to protect and promote human rights in their own countries and abroad. <\/span><span style=\"font-weight: 400;\">However, as referenced below, Russia\u2019s actions in Syria, Ukraine, and Georgia<\/span><span style=\"font-weight: 400;\"> stand in clear contrast to the Human Rights Council\u2019s commitment to human rights.<\/span><\/p>\n<p dir=\"ltr\" style=\"direction: ltr; text-align: left;\"><span style=\"font-weight: 400;\">The UN Member States should particularly take into consideration Russia\u2019s indiscriminate attacks and war crimes in Syria and its ongoing efforts to prevent accountability for human rights violations in Syria; Russia\u2019s occupation of Crimea and ongoing human rights violations in Crimea and the Donbas (Ukraine), Russia\u2019s military invasion and occupation of Georgia\u2019s two-breakaway territories, continued grave human rights violations against Georgian population in the occupied regions, and creeping borderization inside the Georgian territories.<\/span><\/p>\n<p dir=\"ltr\" style=\"direction: ltr; text-align: left;\"><span style=\"font-weight: 400;\">Since the military intervention of Russia in Syria in 2015, Russian-Syrian military joint operations had committed indiscriminate attacks against civilians, protected sites, and civilian infrastructure in <\/span><a href=\"https:\/\/www.hrw.org\/news\/2016\/12\/01\/russia\/syria-war-crimes-month-bombing-aleppo\"><span style=\"font-weight: 400;\">Aleppo<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.hrw.org\/news\/2017\/12\/22\/syria\/russia-airstrikes-siege-killing-civilians\"><span style=\"font-weight: 400;\">Eastern Ghouta<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/www.amnesty.org\/download\/Documents\/MDE2420892020ENGLISH.PDF\"><span style=\"font-weight: 400;\">Idlib<\/span><\/a><span style=\"font-weight: 400;\"> in Syria. In March and July 2020, the UN Independent and International Commission of Inquiry on the Syrian Arab Republic<\/span><span style=\"font-weight: 400;\"> had found <\/span><a href=\"https:\/\/undocs.org\/A\/HRC\/43\/57\"><span style=\"font-weight: 400;\">Russian forces directly responsible for war crimes<\/span><\/a><span style=\"font-weight: 400;\"> in Idlib and provided further and detailed information on the role of Russia in committing war crimes and aiding the Syrian government in conducting <\/span><a href=\"https:\/\/www.ohchr.org\/Documents\/HRBodies\/HRCouncil\/CoISyria\/Idlib-infographic.jpg\"><span style=\"font-weight: 400;\">airstrikes against civilians and the civilian population in Idlib<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><span style=\"font-weight: 400;\"> It is shocking that a\u00a0 State found responsible for war crimes by an HRC investigation mechanism should be granted a seat in the same UN venue without scrutiny from the international community.\u00a0<\/span><\/p>\n<p dir=\"ltr\" style=\"direction: ltr; text-align: left;\"><span style=\"font-weight: 400;\">Protection of civilians in Syria and fulfillment of victims\u2019 rights for justice have been averted by the continuous efforts of Russia to prevent impartial accountability for crimes in Syria, abusing its veto power and using it in contexts of war crimes and crimes against humanity (in defiance of the <\/span><a href=\"http:\/\/www.responsibilitytoprotect.org\/files\/ACT%20CoC%20infographic.pdf\"><span style=\"font-weight: 400;\">ACT Code of Conduct<\/span><\/a><span style=\"font-weight: 400;\"> for the Responsibility to Protect<\/span><span style=\"font-weight: 400;\">), for instance with a veto to <\/span><a href=\"https:\/\/www.hrw.org\/news\/2014\/05\/22\/un-security-council-vetoes-betray-syrian-victims\"><span style=\"font-weight: 400;\">refer Syria to the ICC<\/span><\/a><span style=\"font-weight: 400;\"> in 2014<\/span><span style=\"font-weight: 400;\">, additionally using a veto to cancel a UN inquiry mechanism on the use and adjudication of responsibility for the <\/span><a href=\"https:\/\/www.theguardian.com\/world\/2017\/oct\/24\/russia-uses-veto-end-un-investigation-chemical-attacks\"><span style=\"font-weight: 400;\">use of chemical weapons<\/span><\/a><span style=\"font-weight: 400;\"> in 2017<\/span><span style=\"font-weight: 400;\"> and more recently its <\/span><a href=\"https:\/\/www.reuters.com\/article\/syria-security-russia-un\/russia-quits-un-system-aimed-at-protecting-hospitals-aid-in-syria-idUSL1N2E2122\"><span style=\"font-weight: 400;\">withdrawal from the deconfliction mechanisms<\/span><\/a><span style=\"font-weight: 400;\"> to protect hospitals, schools and other civilian infrastructure from indiscriminate attacks in Syria, and its veto on the <\/span><a href=\"https:\/\/www.reuters.com\/article\/us-syria-security-un\/russia-china-veto-un-approval-of-aid-deliveries-to-syria-from-turkey-idUSKBN24834N\"><span style=\"font-weight: 400;\">cross-border humanitarian aid delivery authorization<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p dir=\"ltr\" style=\"direction: ltr; text-align: left;\"><span style=\"font-weight: 400;\">Since occupying Crimea in 2014 Russia has pursued a policy of changing the peninsula\u2019s demographic composition. This is being done, among other things, through <\/span><a href=\"https:\/\/helsinki.org.ua\/wp-content\/uploads\/2016\/04\/Crimea_Beyond_Rules_special-issue_en.pdf\"><span style=\"font-weight: 400;\">illegal transfer of Russian citizens <\/span><\/a><span style=\"font-weight: 400;\"> to the occupied territory of Crimea as well as through <\/span><a href=\"https:\/\/helsinki.org.ua\/en\/articles\/special-issue-of-the-thematic-review-crimea-beyond-rules-is-out-now\/\"><span style=\"font-weight: 400;\">expulsion<\/span><\/a><span style=\"font-weight: 400;\"> of representatives of Ukrainian, <\/span><a href=\"https:\/\/assembly.coe.int\/nw\/xml\/XRef\/Xref-XML2HTML-en.asp?fileid=24432&amp;lang=en#:~:text=The%20number%20of%20people%20injured,them%20in%20the%20Russian%20Federation.\"><span style=\"font-weight: 400;\">Crimean Tatar<\/span><\/a><span style=\"font-weight: 400;\"> and other ethnicities that are opposed to the occupation. Arbitrary detentions, torture and interrogations of <\/span><a href=\"https:\/\/crimeahrg.org\/wp-content\/uploads\/2020\/02\/chronology-of-pressing-the-freedom-of-speech-in-crimea-eng.pdf\"><span style=\"font-weight: 400;\">journalists and bloggers<\/span><\/a><span style=\"font-weight: 400;\">\u00a0 as well as systematic<\/span><a href=\"https:\/\/krymbezpravil.org.ua\/en\/issues\/crimea-beyond-rules-issue-4-information-occupation\/\"><span style=\"font-weight: 400;\"> freedom of speech<\/span><\/a><span style=\"font-weight: 400;\">\u00a0 violations have become common practice for the occupying authorities.\u00a0<\/span><\/p>\n<p dir=\"ltr\" style=\"direction: ltr; text-align: left;\"><span style=\"font-weight: 400;\">In 2014 open hostilities broke out in eastern Ukraine against the militants of the self-proclaimed Donetsk and Luhansk People&#8217;s Republics, which are <\/span><a href=\"https:\/\/www.bbc.com\/news\/world-europe-31747754\"><span style=\"font-weight: 400;\">unofficially supported by Russia <\/span><\/a><span style=\"font-weight: 400;\">. <\/span><a href=\"https:\/\/assembly.coe.int\/nw\/xml\/XRef\/Xref-XML2HTML-en.asp?fileid=24432&amp;lang=en#:~:text=The%20number%20of%20people%20injured,them%20in%20the%20Russian%20Federation.\"><span style=\"font-weight: 400;\">Russia has been providing them<\/span><\/a><span style=\"font-weight: 400;\"> with armaments and funds as well as carrying out political coordination\u00a0 of the republics\u2019 actions, while <\/span><a href=\"https:\/\/assembly.coe.int\/nw\/xml\/XRef\/Xref-XML2HTML-EN.asp?fileid=24736&amp;lang=en\"><span style=\"font-weight: 400;\">Russian troops have been directly involved in the conflic<\/span><\/a><span style=\"font-weight: 400;\">t<\/span><span style=\"font-weight: 400;\">. The presence of Russian troops in Donbas indicates Russia\u2019s involvement in an <\/span><a href=\"https:\/\/www.icc-cpi.int\/itemsDocuments\/191205-rep-otp-PE.pdf\"><span style=\"font-weight: 400;\">international armed conflict<\/span><\/a><span style=\"font-weight: 400;\">. According to the UN, the number of victims has already reached <\/span><a href=\"https:\/\/www.ohchr.org\/Documents\/Countries\/UA\/ReportUkraine16Nov2018-15Feb2019.pdf\"><span style=\"font-weight: 400;\">40 thousand (including 13 thousand killed)<\/span><\/a><span style=\"font-weight: 400;\">. According to the <\/span><a href=\"https:\/\/reliefweb.int\/report\/ukraine\/human-rights-administration-justice-conflict-related-criminal-cases-ukraine-april\"><span style=\"font-weight: 400;\">UN Human Rights Monitoring Mission\u2019s report Human Rights in the Administration of Justice in Conflict-Related Criminal Cases in Ukraine April 2014 \u2013 April 2020 <\/span><\/a><span style=\"font-weight: 400;\"> published on 27 August 2020, the most widespread violations in the temporarily occupied territories of Donbas and Crimea are abductions, <\/span><a href=\"https:\/\/helsinki.org.ua\/en\/articles\/shadow-report-on-the-russia-s-compliance-with-the-un-convention-against-torture-in-the-occupied-crimea-in-2014-2018-is-out-now\/\"><span style=\"font-weight: 400;\">torture<\/span><\/a><span style=\"font-weight: 400;\">\u00a0 and<\/span><a href=\"https:\/\/krymbezpravil.org.ua\/en\/analytics\/crimean-process-observance-of-fair-trial-standards-in-politically-motivated-cases\/\"><span style=\"font-weight: 400;\"> lack of effective legal remedies<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p dir=\"ltr\" style=\"direction: ltr; text-align: left;\"><span style=\"font-weight: 400;\">In August 2008, Russian previous aggressive policy of supporting secessionist movements in Georgia\u2019s two territories of Abkhazia and South Ossetia, climaxed into the military invasion and subsequent recognition of the two so called independent republics. This marked the first instance of forceful change of borders in Europe since World War II, in grave violation of international law and practice. The military actions against Georgian armed forces resulted in <\/span><a href=\"https:\/\/idfi.ge\/en\/information-about-war-between-russia-georgia-in-august-2008?fbclid=IwAR1MIewuzS-yOAt1tmd-YcLmUSoiT6JRJte1GqXE-lacnOSzpIZ7byzFo2Q\"><span style=\"font-weight: 400;\">408 immediate casualties and 20,000 displaced persons<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><span style=\"font-weight: 400;\"> What is more, the subsequent steps on those territories have taken the form of effective <\/span><a href=\"https:\/\/russianoccupation.ge\/\"><span style=\"font-weight: 400;\">ethnic cleansing<\/span><\/a><span style=\"font-weight: 400;\">, when the houses formerly owned by ethnic Georgians are being annihilated in an attempt to change the history and erase the past.<\/span><\/p>\n<p dir=\"ltr\" style=\"direction: ltr; text-align: left;\"><span style=\"font-weight: 400;\">Unfortunately, this human tragedy is not over and continues as we speak, with the Russian armed forces advancing further into the territory of Georgia, occupying houses, gardens and pastures of the local population, kidnapping them regularly and depriving them the possibility to visit the houses of worship and the cemeteries of their ancestors.<\/span><span style=\"font-weight: 400;\"> Those ethnic Georgians living beyond the occupation line &#8211; most of them ill or extremely old &#8211; are in even worse condition, with their daily lives heavily disrupted and gravely endangered.<\/span><\/p>\n<p dir=\"ltr\" style=\"direction: ltr; text-align: left;\"><span style=\"font-weight: 400;\">Under UN General Assembly Resolution 60\/251, which established the Human Rights Council, members elected to the council \u201cshall uphold the highest standards in the promotion and protection of human rights\u201d and \u201cfully cooperate with the council.\u201d\u00a0\u00a0<\/span><\/p>\n<p dir=\"ltr\" style=\"direction: ltr; text-align: left;\"><span style=\"font-weight: 400;\">As part of its 2020 campaign for election to the Human Rights Council, in January 2020 Russia published<\/span><a href=\"https:\/\/www.mid.ru\/en\/foreign_policy\/humanitarian_cooperation\/-\/asset_publisher\/bB3NYd16mBFC\/content\/id\/4013134\"><span style=\"font-weight: 400;\"> a position paper<\/span><\/a><span style=\"font-weight: 400;\"> with a pledge to \u201c<\/span><i><span style=\"font-weight: 400;\">ensure the protection of human rights and freedoms under international law and in strict compliance by States with their international human rights obligation<\/span><\/i><span style=\"font-weight: 400;\">s\u201d. Russia\u2019s ongoing cooperation with the Syrian government in indiscriminate attacks over the civilian population and attempts to prevent impartial accountability in Syria; its military occupation of Crimea and ongoing human rights violations in Crimea and Donbas (Ukraine),its occupation of Abkhazia and South Ossetia (Georgia) and ongoing human rights abuses against etnic Georgians, do not fulfill the terms of the pledge.\u00a0\u00a0<\/span><\/p>\n<p dir=\"ltr\" style=\"direction: ltr; text-align: left;\"><span style=\"font-weight: 400;\">Electing Human Rights Council members that are truly committed to improve and respect human rights is the responsibility of each UN Member State as provided in Article 8 of the UNGA resolution 60\/251.
