Torture survivors submit criminal complaint against high-level officials of the Syrian Intelligence Service to Federal Prosecutor <\/strong><\/p>\n

Berlin, 2 March 2017 – <\/strong>The Syrian government led by president Bashar al-Assad is responsible for systematic and widespread torture targeting opponents and activists not only as a reaction to the protests in 2011 but already for several decades. There are currently only a few avenues left to prosecute international crimes committed in Syria. One of them is the principle of universal jurisdiction, which allows the German judiciary to become active and initiate first steps towards the road to justice without citizenship of the victims or perpetrators being a prerequisite. The European Center for Constitutional and Human Rights (ECCHR) together with seven Syrian torture survivors as well as the two Syrian lawyers Anwar al-Bunni (Syrian Center for Legal Researches & Studies) and Mazen Darwish (Syrian Center for Media and Freedom of Speech) submitted the first criminal complaint against six high-level officials of the Syrian Military Intelligence Service to the Office of the Federal Prosecutor.<\/p>\n

“We cannot look at the horror of Syria. We have to start describing what is happening in Syria with words and legal categories,” said ECCHR General Secretary Wolfgang Kaleck. “Germany can and must react to grave human rights violations such as torture, massacres and sexualized violence in Syria.” ECCHR has been investigating crimes committed by all parties of the conflict since 2012 and is now working with an international network, including torture survivors who have been granted international protection in Germany.<\/p>\n

The criminal complaint targets six officials known by name and further unknown officials of the Syrian Military Intelligence Service. The claimants were tortured or witnessed torture in the prisons of the intelligence services. The aim of this criminal complaint \u2013 the individual cases of which are exemplary for the system of torture under the Assad regime \u2013 is the issue of international arrest warrants and the begin of investigations by prosecutor’s office with respect to the persons identified as responsible for the committed crimes. “In Syria there is total impunity, which produces further violence. Without justice there will be no political solution to the conflict”, emphasized Mazen Darwish. His colleague Anwar al-Bunni added: “Massive human rights violations must not remain unanswered; this is clear since the Nuremberg trials. Torture is absolutely forbidden. Folter-\u00dcberlebende stellen beim Generalbundesanwalt Strafanzeige gegen syrische Geheimdienstchefs <\/strong><\/p>\n

Berlin, 2. M\u00e4rz 2017 \u2013 <\/strong>Die Regierung von Bashar al Assad l\u00e4sst in Syrien systematisch und fl\u00e4chendeckend foltern \u2013 nicht nur Oppositionelle und Aktivist_innen und nicht erst seit den Protesten 2011, sondern seit Jahrzehnten. Die internationale Strafjustiz hat derzeit wenig M\u00f6glichkeiten, die Verbrechen in Syrien strafrechtlich zu verfolgen. Doch die deutsche Justiz kann nach dem Weltrechtsprinzip aktiv werden. Sieben Folter\u00fcberlebende aus Syrien und die Rechtsanw\u00e4lte Anwar al-Bunni (Syrian Center for Legal Researches & Studies) und Mazen Darwish (Syrian Center for Media and Freedom of Speech) haben deshalb gemeinsam mit dem European Center for Constitutional and Human Rights (ECCHR) beim Generalbundesanwalt in Karlsruhe eine Strafanzeige gegen hochrangige Mitglieder des syrischen Geheimdienstsapparats eingereicht.<\/p>\n

\u201cWir d\u00fcrfen dem Grauen in Syrien nicht fassungs- und tatenlos zusehen. Wir m\u00fcssen das, was dort geschieht, in Worte und in rechtliche Kategorien fassen\u201d, sagte ECCHR-Generalsekret\u00e4r Wolfgang Kaleck. \u201cDeutschland kann und muss einen Beitrag leisten, damit Menschenrechtsverbrechen wie Folter, Massaker und sexualisierte Gewalt in Syrien juristisch aufgearbeitet werden.\u201d Das ECCHR untersucht seit 2012 Verbrechen aller Konfliktparteien in Syrien. Dazu arbeitet es mit einem internationalen Netzwerk, zu dem auch Folter\u00fcberlebende geh\u00f6ren, die in Deutschland Schutz gefunden haben.<\/p>\n

Die Anzeige richtet sich gegen sechs namentlich bekannte und weitere hochrangige Funktion\u00e4re der syrischen Milit\u00e4rgeheimdienste. Die Anzeigeerstatter_innen wurden in Gef\u00e4ngnissen dieser Geheimdienste selbst gefoltert oder Zeug_innen von Folter. Ziel ist, dass der Generalbundesanwalt in diesen konkreten F\u00e4llen \u2013 die exemplarisch f\u00fcr das Foltersystem des Assad-Regimes sind \u2013 ermittelt und internationale Haftbefehle gegen die Verantwortlichen erwirkt. \u201eIn Syrien herrscht derzeit totale Straflosigkeit, die weitere Gewalt produziert. Ohne Gerechtigkeit wird es keine politische L\u00f6sung des Konflikts geben\u201c, betonte Mazen Darwisch. Sein Kollege Anwar al-Bunni erg\u00e4nzte: \u201cMassive Menschenrechtsverbrechen d\u00fcrfen nicht unbeantwortet bleiben, das ist sp\u00e4testens seit den N\u00fcrnberger Kriegsverbrecherprozessen klar. Folter ist absolut verboten. Dagegen muss in Deutschland ein Zeichen gesetzt werden \u201d.<\/p>\n
